General Terms and Conditions for the Use of\nthe Mediation Service (Mediation Conditions) of\nthe Association of Tour Guides of Nuremberg\n'Die Stadtf\u00fchrer' e.V.<\/strong><\/p>\n

Dear guests,<\/p>\n

We are delighted that you have decided to book\na guided tour through our mediation service.\nThe following general terms and conditions\nprovide you with an overview of your rights and\nobligations in the legal relationship between\nyou and the Association of Tour Guides of\nNuremberg 'Die Stadtf\u00fchrer' e.V. as the\nmediation service provider (mediator), and they\nregulate this relationship in a binding manner.<\/p>\n

The guided tour takes place based on a service\ncontract established between you (the\nguest\/client) and the tour guide (contractor).\nThe general terms and conditions that govern\nthis service contract will be provided to you in\ndigital form by the Association of Tour Guides of\nNuremberg upon booking and confirmation of\nthe order, and they are attached to our terms\nand conditions for your reference.<\/p>\n

1.\u00a0\u00a0\u00a0\u00a0\u00a0<\/strong>Basis of Mediation<\/strong><\/p>\n

1.1 The Association of Tour Guides of\nNuremberg 'Die Stadtf\u00fchrer' e.V. acts as the\nmediator of the contract between the guest\n(also referred to as the tour client) and the tour\nguide.<\/p>\n

1.2 The tour guides mediated by the Association\nof Tour Guides of Nuremberg 'Die Stadtf\u00fchrer'\ne.V. enter into a separate service contract with\nyou and use their own terms and conditions\n(AGB). These AGB will be provided to you in\ndigital form by the Association of Tour Guides of\nNuremberg 'Die Stadtf\u00fchrer' e.V. upon booking\nand confirmation of the order. The AGB used by\nthe tour guide become part of the service\ncontract for the guided tour after the contract is\nconcluded, which is confirmed on behalf of the\ntour guide by the Association of Tour Guides of\nNuremberg 'Die Stadtf\u00fchrer' e.V.<\/p>\n

1.3 If a company, institution, or a group of\nprivate individuals books guided tours (such as adult education centers, school classes, clubs,\ntravel agencies, incentive or event agencies),\nthis is considered as a \"booking by a group\nclient.\" This group client is the sole client and\nthus, within the framework of the mediation\ncontract, the contracting partner of the\nAssociation of Tour Guides of Nuremberg 'Die\nStadtf\u00fchrer' e.V.<\/p>\n

1.4 The group client is only not considered the\nclient if, when making the booking, they\nexplicitly agree with the mediator that they are\nmaking the booking only as a legal\nrepresentative of the later participants. In this\ncase, the group client is personally responsible\nfor all costs arising from the booking (including\nadmission fees).<\/p>\n

2.\u00a0\u00a0\u00a0\u00a0\u00a0<\/strong>Termination\/Cancellation\/Non-Utilization by\nthe Guest (Client)<\/strong><\/p>\n

2.1 Once the guest has received the booking\nconfirmation, they can terminate the service\ncontract free of charge only within three full\nworking days before the agreed date. The\ntermination can only be made via email (info@nuernberg-tours.de<\/a>) to the official business office of the mediator\n(The Association of Tour Guides of Nuremberg\n'Die Stadtf\u00fchrer' e.V.). The email must be\nreceived by 4:30 PM of the fourth business day\nbefore the agreed date, in the provided email\naccount of the mediator's business office. The\nmediator is authorized to accept the\ntermination on behalf of the contractor.<\/p>\n

2.2 In the event of termination within three\nbusiness days or less before the appointment,\nthe agreed fee becomes due for payment in full.<\/p>\n

3.\u00a0\u00a0\u00a0\u00a0\u00a0<\/strong>Liability of the Mediator<\/strong><\/p>\n

The Association of Tour Guides of Nuremberg\n'Die Stadtf\u00fchrer' e.V. as a pure mediation\nservice provider cannot be held liable for\nservices and personal or property damages\narising in connection with a guided tour.<\/p>\n

4.\u00a0\u00a0\u00a0\u00a0\u00a0<\/strong>Insurance<\/strong><\/p>\n

The agreed and contractual services include\ninsurance for the benefit of guests or group\nclients only if expressly agreed upon.<\/p>\n

5.\u00a0\u00a0\u00a0\u00a0\u00a0<\/strong>Enforcement and Statue of Limitations<\/strong><\/p>\n

5.1 All claims of the guest or the group client\nmust be submitted in writing. Claims of the\nguest or the client against the mediator,\nregardless of the legal basis, except for claims\nof the guest or the client arising from unlawful\nacts, become time-barred within one year.<\/p>\n

5.2 The statute of limitations begins at the end\nof the year in which the claim arose and the\nguest or the client became aware of the\ncircumstances giving rise to the claim against\nthe mediator, and the mediator themselves as\nthe opposing party to the claim, or should have\nbecome aware of them without gross\nnegligence.<\/p>\n

5.3 During ongoing negotiations regarding\nclaims submitted in writing to the mediator, the\nstatute of limitations is suspended until the\nguest or the client, or the mediator, refuses to\ncontinue the negotiations. The statute of\nlimitations begins at the earliest three months\nafter the end of the suspension.<\/p>\n

6.\u00a0\u00a0\u00a0\u00a0\u00a0<\/strong>Jurisdiction<\/strong><\/p>\n

6.1 The place of jurisdiction is Nuremberg.<\/p>\n

6.2 Lawsuits against the mediator can only be\nfiled at the general place of jurisdiction of the\nmediator.<\/p>\n

6.3 For lawsuits brought by the guest or group\nclient, the general place of jurisdiction of the\nguest or group client shall apply.<\/p>\n\n\t\t<\/div>\n\t<\/div>\n\n\t
